My client is trying to see if there are any possibilities to bring a graphic artist - flash developer from Phillipines, he currently works freelance and has made a big impression with his work. He has shown interest to come to US on h1b and company wants to know if they have any issues in bringing him onboard by sponsering a h1b. The issue is, he does not have college education, other than that, he qualifies excellent for a job in this company. Will he have issues in getting a h1b? Has anyone got H1b visas with college degrees but only with work experience?

I would like know if any of the IV members whose I-140 applications were transfered to VSC for receipting has been approved. If those IV members have received any kind of communication from VSC regarding processing of I-140 please post the details for benefit of other members. My case should have been processed at TSC, but was sent to VSC for receipting and has been stuck there for quite some time. It appears that VSC has stopped processing I-140's as of April 2006 and have not processed any applications since then. I would sincerely appreciate if members with I-140 at VSC to please post any updates they may have received. Any idea when I-140 PP will be reinstated?

At the time of filing my application I just used one address.
Somehow I didn't know you could use Permanent address and current address.
I'm not sure but I guess my lawyer didn't file G325 form.
Is filing G325 form something mandatory ?
I've moved recently.
I want to change the address now but want to give a new address (which is not the address I moved to .)
Should it be fine?

there are many threads on the same topic. it is an error by them when they send a document which can not be classified in anything else in those categories. may be some inexperienced employee is updating it.
i got this when they redirected my finger print notice returned from my previous address. status looks as if my gc is already sent by them but for the last 7 months, it is the same and I haven't got anything other than the redirected finger print notice.

I am not sure if this discussion may be opened by someone already. I could'nt find it and hence I am opening a new one.
I know its not required to have SSN for starting the job from 10/01/2007. I am eager to know if we can apply for SSN before this date or do we need to wait until Oct 1st. Thanks

You could travel out and enter into US using your old visa stamp assuming that you enter before your old visa stamp expires. However show the new approved I-797 H1B petition at port of entry and they MOSTLY will give you a new I-94 valid till the expiration of new I-797 approval.

My I-94 expires in december 2010. I have an approved Advance parole till Dec 2011(I485 is pending). Is it required to travel outside the country and get a new I-94 ?
2. Is there a source on the Net that I can refer to that explains this?

If you are maintaining H-1B status, you can file for status extension and will get new I-94.
If you are using EAD and have I-485 pending "status" then I-94 extension is not necessary.

Remember, you are signing each and every form. Which means you are certifying the following: "I certify, under penalty of perjury under the laws of the United States of America, that this application and the evidence submitted with it is all true and correct."
So when a form asks for your address, it HAS to be YOUR address. Providing any other address would be illegal. Tell your employer he/she cannot force you to commit perjury.

My priority date is Dec 2005 and country of chargeability is India. My application and my son's application were approved on August 04, 2010 but my wife's application is still pending approval. It has been nearly 10 days since derivative applications were approved.
I understand that derivative applications cannot be approved without primary application getting approved first but why, then, my wife's application is still showing "initial review"?
I am confused and getting a little worried about this. Any advice will be appreciated.

Looks like there is a huge backlog of perm applications. I am not sure if they will look at your application anytime soon. If your application is pending more than a year at least you could apply for extension of H1.
It will be delusional on our part to think that perm applications will have an easy approvals.

You are so fortunate. My priority date is May 2006, but my I-140 was only approved & received by NVC last January. We have similar question. I hope the statement from the FAQ of NVC (check http://travel.state.gov/visa/immigrants/types/types_1309.html) will help us.

When you complete a petition (I-130, I-140, etc.) for an immigrant visa you send it to Citizenship and Immigration Services in the Department of Homeland Security for approval. There is a delay between when you get the Notice of Receipt and the Notice of Approval from CIS and also between when you get the Notice of Approval and when NVC receives the petition. After NVC receives the petition, we will create a case record and assign a case number. We recommend that you wait at least three weeks after you get your Notice of Approval before calling NVC if you have not heard from the Center by that time.
