Hi,
My new EB2 I - 140 got approved with my old NIW-I-140 priority Date March 29th 2006 which is current for India now.
My I-485 (EB3) is pending throgh my spouse and I am the secondary applicant
Can I file another I-485 with my new I-140 (EB2) ?
Is there any way we can link my existing I-485 with my new I-140 (EB2)
Appreciate your suggestions.
My attorny is consfused with this situation and trying get mor information.

Hi,
I have a pretty simple question.
A person decides to change employers, moving from company A to company B. It's been 180 days after 485 filing.
Question: what does company B have to do to legally take this person on as full time employee? Is the process any different than taking any other american resident employee? The way I understand is it is not any different.

If you are looking to use your EAD then I believe their is a form that you fill in with your employer and off you go. Informing USCIS or not will be your choice read around in this forum to find different opinions and more info on AC21.

Even so; not being a Vote bank is the reason we cannot do anyting here. Plus we are not united enough to generate enough funds or show enough economic impact (i.e. make our case) with lawmakers to get USCIS to clean up their act. IV is our best chance.

but if i wait until my PD is current, then i contact congressmen, by the time they act on it, pd may go out of current. So just looking to get it out of this loop before my pd is current, so that my file will be ready to process.

I had a positive skin test when I was last tested (18 months ago) but a negative chest x-ray? I did not go on any med's because I suspected that I may have had the TB vaccine for international travel. When my mom supplied my immunizations (yes, it took 18 months to find them!) the only thing I saw that might be the cause of this positive skin test was an immunization that I had when I was one year old that says "TB tinc." I have no idea what that immunization is. Does anybody out there have any ideas?

Thank you for the reply. I should have been more explicit, the extension of H1 was filed by company B on the basis of company A H1 during transfer , the extension was denied but a new H1 approval notice with company B was given.

I think that it was a trial balloon. I have seen this pattern for most of the major issues this administration is planning to tackle. Take TARP for example...for a month one would just hear leaks about proposed solutions. Media would pick it up and give a reaction, the next leak would be an updated version based on the feedback. Such articles help keep the issue in the forefront, help gauge the reaction (both positive and negative) and provide a simple exit to backtrack incase of major opposition. :rolleyes:

I am wondering if anybody had done this before: I want to work part time (20 hrs/week) for 6 months( and no other job). I am on H1 but I also have EAD. So I am wondering if there are any implications to this such as I need to amend my H1b , because of some obscure law my GC process will be affected. Any input is appreciated.

I had a friend in the same situation. Had H1 and EAD. He worked halftime for two years to finish his MBA. Now went back to fulltime H1. I think your company has to approve it and yes he filed ammendment.

We filed our 485 on July 2nd 2007 at Nebraska office � EB3 � July 7, 2001
- The case was shifted to Texas and we received notices from Texas office with receipt date of August 27.
- Our date is now current however processing at Texas is still stuck at June 27, 2007.
- Does this mean our RD is now 08/27/07 even though it was recd. at Nebraska on 07/02/07??
Check your I-797 - receipt notice for your I-485. In that there is a received date. That is your RD. There is another field, notice date or ND that might change depending on the transfer. If the RD is different from July 2nd, you can talk to the customer service and try to get it corrected.
BTW, though they have to process in the order of RD, I don't think they are following it. From reading here and other forums, I think they are following the ND.

It is doubtful that anything other than amnesty would kill this legislation.
There is a serious risk for the Democrats in forcing their members to vote
down an amnesty bill. That would undoubtedly alienate one of their core
voter constituencies.
If the SAVE bill passes, the likely result is that support for legal immigration reform will increase substantially. A number of members of Congress have said that they support legal immigration reform, but first want to see new enforcement measures put into place"

Wrong info.
Denial of "extension of stay" wont invalidate "visa stamping".
also if you get denial stamp no longer be valid. This is what I also read online.
