I hope you realise this is a serious issue. You need to find out from your employer who filed your H1 whether he filed it as a "Change of Status" (COS) petition or "Visa to be issued abroad category".
If it was a H1 COS petition, then you have been accruing unlawful H1 status since your H1 start date as your status automatically changed from H4 to H1 (assuming your approval came with an attached I-94). In this case, you need to get back to H4 status. You can do that by re-entering US on a valid H4 visa (preffered way) or by filing a new H1 to H4 COS petition.
If your H1 petition was not filed under COS (filed under Visa to be issued abroad category), then you are still on H4 status (assuming you have been maintaining a valid H4) and there is nothing you need to do. If you want to convert to H1, then you need to go to a consulate mentioned on your H1 application, attend the H1 interview and re-enter US using H1 stamp.

Just to let everyone know if any of you encounter the same issue -
called up USCIS Customer Service and spoke to them about this error. They said to mention this in the Cover Letter (When I send the supporting docs) as a mistake that happened while filing the EAD and what the correct answer should be. They said it'll be then taken care of.
Am going to do accordingly!

Hi There,
My 485 application is pending at TSC on EB3 category, country of chargebility is Inida. Yesterday my PERM labor approved on EB2 category and need to apply 140 to recapture my own EB3 PD.
My employer will come under NSC. if the PD recaptured, I will be hardly one month away from my priority date to be current, as per the current visa bulletin dates.
So can you please provide some suggestion to which Service Center will be opt for filing EB2 140 now, in order for getting an optimal process for 140 and eventually 485?
Or does the service center really matters as it will take a very long time for me to get greened?

I am curious of the average networth of H1Bs excluding their parent's money. The money they just made so far. Not sure how to start a new thread. I read somewhere online there are lot of H1Bs who are working for 10 years are almost millionaires. Can they use their accumulated wealth to do an investment based green card.

1. Do you know any process of H1 stamp transfer on different new citizenship passport.
2. Is there's any wages difference between H1 & E3 ? Because I have heard while you are on H1 agents will take atleast 30% commission from your salary.

that shouldn't be any issue. She would be admitted at POE. However if she has filed for H4 extension and if the H4 extension is pending when she enters into US, the H4 extension will be considered abandonded and will be asked to go to consulate for stamping before her I-94 expires and can't use the approved H4 extension's I-94. check with yuour attorney on it.

I filed I 765 with Vermont service center on April 30,2009 and even got the I 797 C receipt. When I tried to check the case online it gives a message that
Your case can not be found at this time in Case Status Online. Please check your receipt number and try again. If you need further assistance please call the National Customer Service Center at 1.800.375.5283.

Is it possible to convert or interfile an existing EB based I-485 application to FB based I-485?
I have pending I-485 through an approved I-140 (EB). PD is not current. I recently got married and my spouse is a US Citizen. We are considering pursueing FB application. Reading through the forums I gather that my spouse has to file I-130 and I file for I-485. My question is regarding I-485.
If I have to file for a new I-485, what happens to the existing one? Do I have to get new medical exam? Can I use existing AP, EAD or can I use EAD/AP that I currently have from my EB based application?
If an interfiling is possible, when should this be done - concurrently along with I-130 filing or we have to wait till I-130 is approved? Also what is the procedure for "interfiling"?

Ok, you know I love your pictures, so I played with curves and masking. Since I've been on the coast many times, I know those cliffs have a lot more detail than your photo, so I wanted to bring them out. I went for subtlety and not intensity in the color version. I don't know if it looked like this or not, but this is what I imagine it to be. Layering and adjusting curves can significantly change the "feel" of the picture to more closely emulate what you saw.
Also, I really like the BW version for dramatic feel. Michael Michael Michael.... you do such nice work... there's always a jewel in the center with a bit of tweakin... that's what I love about your work! Many possibilities with one pic! :)

included in the House-passed version of the Deficit Reduction Act of

You cannot travel and enter US with expired AP. Please renew your AP. Stamp on AP cannot make any difference as per my knowledge. You will have your I-94 also with same time stamp.

My AP document expired in NOv 2008. I traveled to India and got back in Aug 2008. The officer stamped the document and wrote paroled until Aug 2009.
Can I travel on this document?

I dont think it is allowed. One would think that working outside the US while you are waiting for "Adjustment of Status" would be considered abandonment of your I 485

I applied by mail to the DC embassy. I sent photocopies of everything and no problem.
The only thing to note though is that the DC embassy took a whole month to process my visa. I was going to Canada in September, applied in early july and received it somewhere in August. In the meanwhile when enquired about the status through email, they said they will delay it more now because I enquired. :) (and we think Indian govt. offices have bad attitude)
So I'd advise you to accomodate for the long time to get the Visa, if applying by mail.

Your mother must rely on the I-94 and file an extension if she wants to stay more than 3 months. The extension can be filed any time before the I-94 expires.

Try in the early morning hours like 5 - 6 AM EST ....
If any one of your parent can speak English then you can take the appt in English. I did it for my In-Laws and they got the visa.
