Is this still an issue?
Seems like it is still an issue.
"By weeks end, Congress is expected to (again) re-up funding for the federal government to (again) avert a government shutdown for another three weeks.
Congress is slated to approve a three-week spending measure over the next few days that would extend a March 18 deadline to keep the governments lights on until April 8. In the meantime, lawmakers hope they can agree on a longer-term continuing resolution through September when this fiscal year ends."

Dear Sir / Madam
I am a software consultant on H1B. I have recently concluded my employment in California for client A and now I have relocated to GA where I am working for client B.
I have the following questions in this regard:
1) Should I do an LCA transfer to the state of GA from CA? + How many days do I have from the date of original relocation to do this transfer?
2) Can I do this paper work by myself or would I need the help of an immigration lawyer? + Any idea of what the average / approximate expense would be?
Any information with regards to this is highly appreciated.
Many thanks in advance.
Your Company has to file LCA not you. Technically they have to file H1B amendment. Many people does not this. It has to be filed Immediately. There is nothing like grace period.

Not sure if I posted this on right forum....
I'm at 485/EAD stage. not on H1b anymore. I recently badly sprained and fractured my ankle/foot. Am considering taking a leave for maybe two weeks from work.
Question: does going on short term disability and getting benefits from the state have any adverse effect on the immigration process?
Please let me know. Thanks.

Hi,
I am wondering if I can sent both my and mywifes EAD applications in one envelope to USCIS or do I have to send them separately. I am not asking to save money on postal costs , as everyone knows we all spent 1000's of dollars in this GC process. I am only asking so that our(my and mywife) applications are processed together?
Thanks in advance for your input
Regards

Hi ivvm. Thanks for the info. DO EB-1 and EB-2 require LC? Would the NIW bypass LC? Is NIW filing equivalent to EB-2? What is the importance of Job description?
Sorry for asking so many questions. Thanks for taking the time to reply.

I need help on my I485 pending case:
When I was a PHD student I filled NIW (national interest waiver) and got my I-140 approval (priority date is 6/22/2006). Now I am working for a Telecommunication company.
My NIW I-140 form stated my job is:
SOC Code: 17-2112
Nontechnical description of job: Operations research and logistics with optimization and numerical analysis.
In my NIW cover letter, I stated my contribution in airline industry with the operations research and optimization knowledge. My current work is still related to the operations research and logistics but my contribution is different now. Does that mean I am not in the same research/work field? Some attorney said my I-485 will most probably be denied because I am not benefit to airline industry now. Is this true?
What is the definition of the same/similar field? I thought I should be safe as long as I continue to work on OR and logistics related work, even if my work on different project or for different companies.
When USCIS process I-485, they will look at the job description on I-140 form or the contribution in cover letter?
An attorney suggested me to apply a PERM as a backup to keep the existing priority date (6/22/06), in case my NIW-based 485 case has any issue.
What's the percentage of chance that you think my 485 can be denied due to the working field issue? I originally thought it's very small (less than 5%), and I just need to wait for the Visa availability. Is it correct?
My husband's H1 visa is about to reach the 6 year limit in March 2011, and he was thinking to use EAD from my 485 case until we get green card. Is this a good plan, or he need to apply a PERM as a backup too? Is it too late? What would be a good plan?

Not sure if I will make the category, but feel that I should consult with a good immigration attorney and explore the option. Who knows? I wish there was a category for people who were doing the work that directly improved the lot of the American people. Not-for-profit is not lucrative nor glamorous, so there should be some incentives :)

I have
EB3 140 approved for June 2004
and
EB2 140 approved for May 2006
My lawyer said that they will file a petiton to apply my EB2 status to my EB3 dates as soon as dates for EB2 cross June 2004
But now, In this August VB , My EB2 became current .
What I did not anticipate was the huge 2 year+ jump in EB2 dates
My 485 was filed in July 2007 and shows the status pending since then.
I asked my lawyer which 140 did he use to apply my 485 and he says "Both"
I am confused with a couple of things
1. Is it possible to file 485 by sending in both 140s. I asked the lawyer and he said that NOW since the date has jumped more than 2 years it is not advisable to file petiton to move dates .
2. If I call USCIS , will they be able to tell me which 140 was used to file my 485:confused:

My lawyer initiated the PERM process late last year, the timeline was such that the prevailing wage request was filed with State Workforce Agency (SWA) on 12-30-2009. The SWA prevailing wage determination was received back by my lawyer on the 1/11/10.
Subsequently the recruitment process started and everything was going smooth. The PERM was supposed to be filed in the first week of April. My lawyer now is saying that they need to push the application filing because of the new rule which came into effect Jan 1st which requires all prevailing wage requests to be filed with the DOL. The rule states that:
On January 1, 2010, the U.S. Department of Labor (DOL) changed the way that prevailing wage determinations (PWDs) are processed for the PERM, H-1B, H-1B1 (Chile/Singapore), E-3 (Australia), and H-2B programs. PWDs are now issued by DOLs National Prevailing Wage and Helpdesk Center (NPWHC) in Washington, DC. Below are updated Frequently Asked Questions about the new process.
From my understanding the new law should not be applicable to me, since we filed for the PWD on 12/30/09. I am not sure why we need to reinitiate the process, since the new law is _effective_ as of 01/01/2010.
Is anyone in a similar situation or anyone has any advice?

Political scene and policy making is mostly based on vote and voice more then TRUE reform. Always, be it India or USA.
Immigration-Voice is primarily for legal immigrants. Even though we input substantial economic value to the society, and to the fate of all of us the small legal/skilled people immigration reform is tied to the big CIR.
What I want to propose is to talking to other lobbing groups and immigrant associations.
Irish, Spanish etc... Today in the news the Irish Lobby for Immigration Reform (ILIR) made a big show and seems like they have got lot attention. Form senator Clinton to one time Irish Kennedy all spoke for Irish and CIR.
Also, Immigration voice is primarily supported by Indians and few other people from other nationalities.
In addition, I being an Indian like to propose bringing more attention and contributions to the situation by talking to local and north American Indian associations both professional and cultural.
To name a few...
American Association of Physicians of Indian Origin
Telugu Association of North America
American Telugu Association
FOGANA - Federation of Gujarati Associations of North America
Federation of Tamil Sangams of North America etc..
