It costs time, stress, sleepless nights, anxiety, restlessness and some hair loss(the list could be long for others) if you get a RFE relating to AC21, these are all bonus in addition to the money you spend for filing MTR.

I'm interested in purchasing a better Nikon Zoom lens for my D70s. I have the 18-70 DX lens (which is great), but I also have the basic 55-200mm zoom (which I am not happy with). I've been searching online for a 70-300 Nikon lens & I can't figure out which one to get. There's the 70-300mm f/4-5.6D ED AF Zoom-Nikkor & the 70-300mm f/4-5.6G AF Zoom-Nikkor. Which is the better model, the D series or the G series? I'd like to get the new 70-300 VR, but my pocket can't handle that right now.
Any help would be greatly appreciated.
Thanks.
Keith

thanks for the quick response,
Th I-140 is not revoked yet, but the original company that filed it is going to split in to 2 separate companies by the end of the year and I think I-140 will become invalid after that right if the original company doesnt exist anymore??
You can still claim the PD of your old I-140. Once an I-140 is approved PD is yours to keep for life.
Please see a note by Ron Gotcher below.

I was just wondering if they stall the 485 processing once they issue an RFE on EAD. Would they hold the case in abeyance or are these two mutually exclusive.
Btw, am not sure of the reason for RFE yet.
Has anyone had their 485 approved with an RFE pending on EAD or AP?
EB2-I
PD: June 2004
I140 Approved: Aug 2006
485 RD: July 26, 2007
RFE on EAD: Aug 6, 2008

Hi Gurus,
Please suggest me the best option as i am still undecided.
My employer terminated my employment when I lost my job with the client company during 2nd week of June 2009. Before termination, my employer filed my GC and I have my EB2- 140 approved (PD- Feb 2007) and also My previous H1 extended last year 2008 and they have issued my visa for another 3 yrs (3rd term in H1). Since then I am without job and looking for an opportunity. But to be on safe side I left the country before the 30 days of my termination. I came back to US on H4 visa (so that I will be in-status and my GC won't get affected).
Now i am getting an opportunity for a FT position with a company and now I am undecided what to do? If I took the FT with a new company and then my GC process will start from beginning (applyng labor and then once approved (don't know how long it will take to approve labor in EB2) I can then file for 140 porting my previous approved 140 -eb2 with PD Feb 2007) or Just wait until I find a contract job and go through my previous employer and continue my GC process from where it is left.
Currently the PD for EB2-I is in 2005. So should I wait and go smoothly with my previous employer (but still we don't know how long it will take) or go with the FT.
Please suggest me.
i am badly need your advice.

I read a few of the comments and quickly realized that its just trash
I refuse to post a comment when the caliber of people commenting on there is so low that they will gain nothing from my comments and only possibly use it to spread more hatred.
All they are doing is openly showing that they have no intelligence and are not worth the attention they get.
Why bother to comment when they can't finish a proper sentence without abusing. I got better things to do.

I do not know if this has been posted on this forum..
But some of the testimonials are interesting for Students & STEM based EB applicants..
This is from Immigration-law:
02/14/2008: House Subcommittee Hearing on Status of Visas & Policies on Foreign Students and Scholars on February 7, 2008
The House had this important hearing that can have an impact on the employment-based immigration issues relating to the STEM foreign graduates in research and higher learning institutions. It is suggested that the EB immigrants in STEM to review the testimonies of witnesses in this hearing.
Purpose and Summary of the Subject
Testimonies of Witnesses:
:: Opening Statements by Rep. Brian Baird
:: Witness Statements ::
Mr. Tony Edson
Ms. Catheryn Cotten
Dr. Harvey Fineberg
Dr. Allan E. Goodman
Under the current political environment and a long pause in the employment-based immigration legislation issues in the Hill, this is indeed an important news in that at least the Congress is giving attention to the predicament the research and higher learning institutions are facing owing to the failure of the do-nothing Congress and the Administration to act on the matter.

Thomas Friedman has a great op-ed piece in today's NY TImes that emphasizes that the US is going to have to innovate like crazy if we're going to emerge from this recession on top. And a liberal skilled immigration policy has got to be part of our strategy. Here are some of the key quotes: I still believe that America, with its unrivaled freedoms, venture capital industry, research universities and openness to new immigrants has the best assets to be taking advantage of this moment to out-innovate our competition. But we should be pressing these advantages to the max...

I recently found out that someone had stolen my credit card information to purchase items online. I have since then closed that credit card and went ahead and put a fraud alert for 90 days on my credit report. I don't believe my SSN was stolen, but I want to check my credit report and also for protection have the alert so that no one tries to apply for loans etc. using any of my information.
Will having the fraud alert have an impact on my 485 filing in any way? Let me know what the best process is to handle this if it does have an impact on 485 background checks, and pending green card approvals etc.
I have no criminal history.
Thanks,
ROW

485 Received Date 7/27/2007
Fraud alert does not go into your permanent credit report. All this does it is that when you try to open a new loan/credit account, the lender will see that there is a fraud alert on your profile and may call you to verify. It should not have any effect on your I-485.
I have been thinking of signing up with lifelock.com. You may wanna check them out.

Thanks OP for posting these articles. Really great articles.
Hey I would suggest and ask everyone to send the emails to the BW and SFMAG and thank them for writing such good articles. This will motivate them to write more articles like these and gets us in the picture and our issues which will help in CIR
Both are good articles. Thanks for posting.
I agree with you. We should be writing in the comments area of both these websites to show support for such articles.

USCIS website does not shows that my I-485 has been denied but instead it says that it has been sent to AAO office(appeal processing office).
No I have not yet called attorney on extending EAD based on I-140 denial.
------------------------------
Is your 485 also denied? Most of the times when ever 140 is denied then the underlying 485 also gets denied and if that is the case then you cannot apply or extend for EAD or AP until your appeal is pending with AAO. I may be wrong so consult an attorney.
BTW....did you consult the attorney? If yes, what did they tell you?

I will be travelling outside US using AP by end of this month. I don not have valid stamped visa. Recently small part of my old company (A)got acquired by new company and my job was moved to new company (B)
Lawyer at company B applied for New H1 in May 2008 ( old is still valid till 2009)but havent received approved 797 notice yet.
Can I travel outside US and comeback without haveing approved new 797 notice. I do have EAD and old 797.
Any issues ? I dont want to abandon my H1 status.
Gurus please advise.
Thanks
BAsed on what I know, even if you use AP to re-enter and continue to work with the GC petitioning company, your H1 status is still valid.
Your scenario is you will be reentering on AP , but switching the job to a new employer. You may lose your H1 status

Hi guys,
I have an urgent case regarding the I-485 initial evidence. I sent out my I-485 application w/ I-864 and I-864A back in November, 2009. I am a F-1 visa holder currently in PhD program with around 21,000 stipend per year. My wife which is the petitioner (I-864) has no income and she filed a I-864 with my stipend in the first I-864 form. Since I am the beneficial and the instruction said that I didn't have to include my W-2 form. My parents in law had a joint account together. My father in law filed another I-864 form with his stipend of 20,000, and my mother in law filed a I-864A form with her stipend of 20,000. They have joint tax returns, and I have given immigration the copy of their 3 years W-2 and 1040 form.
A few days ago, immigration has send me request for initial evidence (I485) with the check marks says
1. The household member on the petitioner/sponsor's form I -864, must submit the federal income tax return submitted to the IRS for the most recent tax year.
2. The household member on the petitioner/sponsors form I-864, and I-864A must submit all supporting tax documentation (W-2s) submitted to the IRS for the most recent tax year.
My question is, I have submitted my parents in law's tax return for 2006 to 2008. we do not have the year 2009 because it is not going to be ready until April. What do they want?
