We did the exact same thing. We informed officer that my wife's Extension is pending, he said that's fine and gave her I-94 valid for 40 days (time remaining on her H4 visa).
After she get her I-94 for 40 days then if her new H4 application is approved then she will get the extension of her I-94.

If your I-140 gets approved when you are already in the sixth year, can you still seek the 3 year extension?

I am not sure if I am posting this question in right thread or not.
My attorney (Dumbest creature on this earth) filed my I-485 (AOS) application on 30th June, 07 recd. on 2nd July at 10.45 am. I was under this impression that all 3 stages 485/765/131 were filed along to uscis.. but I was wrong. My attorney only applied for 485 saying that they were very busy and will file for 765 and 131 (EAD and AP) after we get 485 adjudicated.. BS..
Anyways.. My question is.. since 485 was mailed out via attorney's office, can I go ahead and apply for 765 and 131 on my own, bypassing attorney's effort or am I stuck with them to wait for their mood-swings to go ahead and file my papers. The deadline with old fees application is 30th July as per the news bulletin. I dont want to waste time for 485 to get adju. and then file for 765/131.
Please advise me about this situation. Also I don't have any proof of 485 application being submitted. I only have tracking number of Fedex that the application was delivered on 2nd July. GOSHH.. pls. advise me.

I had the same problem with my PERM. my last name had an extra letter in the end at one place but was fine at the other place. My perm was approved without any issues.
At I-140 stage my lawyer made a note of this to USCIS and now my I-140 was also approved without any issues.
I am pretty sure your audit is not related to that because they have no way to to know your real name! at the labor stage

dont worry about it. As long as you can prove that you have been treated/or under treatment, this will not hold your application. This will increase / slightly delay your initial application , but otherwise u shouldnt have any problems

As the house will go into a recess after around a month, is anyone seeing a possibility for a congressional action regarding the three pending immigration bills in the house? �A realistic possibility?
As per the calendar, we have time till August 4 and between September 7 & September 26, to get something done in Congress. It might be really difficult to get something done in September as that short time may be used by the congress for many high priority items.

August 4 to September 7: House August Recess
August 9 to September 7: Senate August Recess
September 26: House Target Adjournment Date
I am wondering, what else I could do to push our bills to fruition.

I thought it was E-verify and our bill with some sunset bills. Now he excluded those things and added last item which Republicans never supports. So he is making this as suicide bill . This is all about politics. See how they turned back in last minutes. Now they created a image of Immi friendly but eventually they didn't fight for us. Bob was Anti in beginning and he introduce recapture so get our support now after becoming popular among us and our friends , relatives he is officially not stopping bill but killing it.

No problem, because of the work NSC are transferring some cases to Texas. In fact, Texas center is issuing EAD and AP so fast. so your wife will get her EAD very soon.

Like PMAT mentioned, I-539 is to be used, and you can do it by yourself, if you'd like. Download the latest form from http://www.uscis.gov/files/form/ (immigration forms).
You will need, I-129, photocopy of your passport, your I-94 (current), Photocopy of Marriage certificate.
